2. Employer

Business entities or individuals registered on the Hire Tech Talent platform with the intent of recruiting Talents for employment opportunities.

3. Service

The comprehensive offerings of the Hire Tech Talent platform, which include website functionalities, job postings, communication tools, and any other services provided to Employers and Talents.

4. Terms

The Terms of Use which constitute the legal agreement between Hire Tech Talent and its users, including both Employers and Talents.

5. Account

The individualized profile created by an Employer or Talent on the Hire Tech Talent platform to access and use the services provided.

6. Hiring Credits

Allocations provided to Employers under certain subscription plans that can be utilized to engage and recruit Talents on the platform.

7. Placement

The act of an Employer successfully hiring a Talent through the Hire Tech Talent service.

8. Confidential Information

Any proprietary data or information obtained through the Service that is to be kept secure and undisclosed outside the intended recruitment and hiring processes facilitated by Hire Tech Talent.

9. Access Data

The login credentials, including usernames and passwords, and any associated security data used by Employers and Talents to access their Hire Tech Talent accounts.

For Talents

1. Overview and Scope

  • 1.1. Service Description

    "Hire Tech Talent," (the Platform) ("we," "us," or "our"), is a specialized digital marketplace accessible via hiretechtalent.com and other affiliated channels. It's designed to connect skilled professionals seeking employment ("Talent") with potential employers ("Employers"). Our comprehensive services include hosting professional profiles, job postings, application submissions, and providing communication tools to streamline the hiring process.

  • 1.2. Acceptance of Terms

    By registering or using any part of the Platform, Talent agrees to these Terms of Use ("Terms"). These Terms form a legally binding contract between Talent and Hire Tech Talent. If Talent does not agree with any Terms herein, they must refrain from using the Platform.

  • 1.3. Third-Party Services

    The Platform may interface with services operated by third parties, which include, but are not limited to, external app stores, social networks, or payment processors. These services are governed by their own terms and are not endorsed or controlled by Hire Tech Talent. Interactions with these services are at Talent's own risk.

  • 1.4. Device Compatibility

    The Platform's services may have varying levels of functionality across different devices or operating systems. We endeavor to optimize compatibility but cannot ensure uniform service experiences across all platforms.

2. Talent Eligibility

  • 2.1. Age and Legal Capacity

    Only individuals who are legally recognized as being able to form contracts may register for the Platform. By creating an account, Talent confirms they meet the legal age requirement and have the authority to enter into these Terms.

  • 2.2. Account Registration

    Creating an account requires you to provide accurate and up-to-date personal, educational, and professional information. Maintaining the accuracy of this information is your ongoing responsibility.

3. Registration and Agreement Commencement

  • 3.1. Account Creation

    Joining the Platform involves setting up a unique account by providing required details. Talent must ensure that the information provided during sign-up is comprehensive and truthful.

  • 3.2. Binding Agreement

    By finalizing the registration process, Talent enters into a binding agreement with Hire Tech Talent, which is governed by these Terms. We reserve the right to refuse the creation of an account for any individual based on non-compliance with our registration criteria or for any other reason at our discretion.

  • 3.3. Verification

    To maintain the Platform's integrity, we may require verification of Talent's credentials through methods such as documentation review, background checks, or interviews.

4. Usage and Conduct

  • 4.1. Acceptable Use

    Joining the Platform involves setting up a unique account by providing required details. Talent must ensure that the information provided during sign-up is comprehensive and truthful.

  • 4.2. Prohibited Conduct

    The Talent is expected to act responsibly and legally when using the Platform. Actions that disrupt service operation, infringe upon the rights of others, or violate any laws are strictly forbidden and may result in immediate account suspension or termination.

5. Platform Functionality

  • 5.1. Talent Profiles and Employer Interaction

    Talent agrees to create a professional profile that accurately reflects their skills, experience, and job preferences. Employers use these profiles to identify suitable Talents for open positions. Talent can receive and respond to interview requests and proposals from Employers through the Platform.

  • 5.2. No Guarantee of Employment

    We facilitate connections between Talent and Employers, but we do not guarantee job placement, employment, or any specific outcome from using the Platform.

6. Talent Responsibilities

  • 6.1. Profile Accuracy and Updates

    Talent commits to maintaining an accurate and truthful professional profile. It is crucial to update the profile to reflect any changes in qualifications, experience, or employment status.

  • 6.2. Account Security

    Talent is responsible for safeguarding their account information, including usernames and passwords. If unauthorized use of Talent's account is suspected, it must be reported to us immediately.

7. Employment and Payment

  • 7.1. No Fees for Talent

    The Platform is offered free of charge to Talent. There are no fees associated with creating a profile, responding to job postings, or accepting job offers through the Platform.

  • 7.2. Reporting Employment

    If Talent secures employment through the Platform, they are required to inform Hire Tech Talent within a reasonable timeframe, as outlined in these Terms.

8. Service Quality and Technical Issues

  • 8.1. Ongoing Development

    The Platform is a dynamic environment, continually being updated and improved to enhance user experience and functionality. These changes may affect the way Talent interacts with the Platform.

  • 8.2. Issue Reporting and Resolution

    We encourage Talent to report any technical problems encountered while using the Platform. We commit to addressing such issues promptly to ensure a high-quality user experience.

9. Limitation of Liability and Service Availability

  • 9.1. Liability Exclusions

    Hire Tech Talent] is not liable for events outside our reasonable control that may interfere with our ability to provide the Platform's services. This includes technical failures, natural disasters, and other force majeure events.

  • 9.2. Service Uptime

    We strive for maximum availability of the Platform but cannot guarantee uninterrupted service. Scheduled maintenance, unforeseen technical issues, or external disruptions may affect accessibility.

10. Intellectual Property Rights

    All content and materials on Hire Tech Talent are owned by the platform or its licensors and are protected under copyright laws.

  • 10.2. Employer Content

    Employers grant Hire Tech Talent a license to use the content they submit to the Service for the purpose of facilitating the Service's intended recruitment functionality, subject to applicable copyright laws.

11. Confidential Information

  • 11.1. Confidentiality Commitment

    Talent agrees to treat all non-public information accessed through the Platform as confidential and to use it solely for purposes related to the services offered by the Platform.

  • 11.2. Disclosure Restrictions

    Confidential information obtained through the Platform must not be shared with third parties without explicit written consent from Hire Tech Talent, except as required by law.

12. Term and Termination

  • 12.1. Terms Effective Duration

    These Terms remain in effect until terminated by either Talent or Hire Tech Talent. Talent may deactivate their account according to the procedures outlined on the Platform.

  • 12.2. Termination by Hire Tech Talent

    We reserve the right to terminate or suspend access to the Platform for breach of these Terms or for conduct that we deem harmful to the Platform or its users.

13. Data Protection and Privacy

Your personal information is shared only as necessary to provide our Service. We respect your privacy and adhere to robust data protection practices in compliance with the General Data Protection Regulation (GDPR).

14. Modifications to Terms of Use

    These Terms and the relationship between Talent and Hire Tech Talent shall be governed by the laws of the jurisdiction where Hire Tech Talent is legally registered.

  • 15.2. Jurisdiction for Disputes

    Any disputes arising from these Terms or Talent's use of the Platform will be subject to the exclusive jurisdiction of the courts located within the legal domicile of Hire Tech Talent.

By using the Platform, Talent affirms their understanding and acceptance of these detailed Terms. If Talent does not agree to any of the Terms outlined, they should not register for or use the Platform.

Employers, which may be business entities or individuals, can access a variety of services, including job postings, talent search, and communication tools to engage with potential hires.

  • 1.2. Acceptance of Terms

    Employers are subject to these Terms of Service ("Terms") upon registration and use of Hire Tech Talent. These Terms constitute a binding legal agreement between Hire Tech Talent and the Employer. If an Employer does not agree with any part of these Terms, they should discontinue the use of the Service.

  • 1.3. Third-Party Services

    The Service may integrate with or offer services from third parties, such as payment processors or social networks. Hire Tech Talent is not responsible for these services. Employers' use of such services will be subject to the terms and conditions of the third parties.

  • 1.4. Application Compatibility

    Employers are advised that the Service's functionality might vary across different devices and platforms. We endeavor to support a broad range of devices but cannot guarantee a uniform experience.

2. Appropriate Use and Conduct

  • 2.1. Service Utilization

    Employers are expected to use the Service in a professional, lawful manner in line with the intended purpose of job recruitment and talent acquisition.

  • 2.2. Prohibited Actions

    Employers must not engage in any activity that could compromise the integrity of the Service or violate the rights of others. This includes, but is not limited to, sharing sensitive information without consent, misrepresentation, or conducting illegal activities through the Service.

3. Service Functionality and Responsibilities

  • 3.1. Recruiting and Engagement

    Employers may set up profiles, post job opportunities, and send interview requests to Talents. The Service's functionality facilitates these interactions, aiming to connect the right Employer with the right Talent.

  • 3.2. No Guarantee of Placement

    While Hire Tech Talent provides a platform for engagement, there is no guarantee that Employers will successfully recruit Talents through the Service.

4. Employer Obligations

  • 4.1. Accurate Information

    Employers must provide truthful and complete information when creating profiles and job postings. They are responsible for the content they submit to the Service.

  • 4.2. Account Security

    Employers must safeguard their login credentials and are responsible for any activity under their account. Any unauthorized use must be reported to Hire Tech Talent immediately.

5. Payment Terms

  • 5.1. Subscription Fees

    Fees for subscription-based services are payable in advance and are non-refundable, except as expressly provided in these Terms.

  • 5.2. Hiring Credits

    Employers are allocated a specific number of Hiring Credits under the terms of their subscription, which can be used towards recruiting Talents.

6. Talent Recruitment

  • 6.1. Notification of Hire

    Employers must inform Hire Tech Talent within a specified period following the successful hiring of a Talent sourced from the platform.

  • 6.2. Placement Details

    Employers are obligated to disclose the terms of employment, including salary and contract details, to Hire Tech Talent for record-keeping and service improvement purposes.

7. Non-Circumvention Clause

  • 7.1. Direct Engagement

    Employers agree not to circumvent the Hire Tech Talent platform by engaging Talents directly or through other parties within a stipulated time frame after initial introduction through the Service.

  • 7.2. Penalties for Violation

    Breaching the non-circumvention clause may result in substantial penalties, emphasizing the importance of adhering to the agreed terms of service use.

8. Service Quality and Limitations

  • 8.1. Service Evolution

    Hire Tech Talent continuously evolves its Service, and Employers acknowledge that these developments may affect how they use the platform.

  • 8.2. Technical Support

    Hire Tech Talent commits to providing timely assistance for any technical issues Employers encounter with the Service.

9. Limitations of Liability

  • 9.1. General Limitations

    Hire Tech Talent's liability for damages arising from the use of the Service is limited, except in cases of gross negligence or intentional misconduct.

  • 9.2. Service Availability

    While Hire Tech Talent aims for the highest level of service availability, it acknowledges that interruptions may occur and are often beyond reasonable control.

10. Intellectual Property Rights

12. Agreement Duration and Termination

  • 12.1. Term of Service

    These Terms are effective upon Employer's acceptance and continue until terminated by either party.

  • 12.2. Right to Terminate

    Both Hire Tech Talent and the Employer have the right to terminate the Agreement in accordance with the provisions set out in these Terms.

13. Data Protection Compliance

Employers must adhere to strict data protection standards when handling personal data of Talents, as outlined in Hire Tech Talent's privacy policy.

14. Amendments to Terms

  • 14.1. Updates to Terms

    Hire Tech Talent reserves the right to amend these Terms and will provide notice to Employers regarding any significant changes.

  • 14.2. Acceptance of Revised Terms

    By continuing to use the Service after changes to the Terms, Employers are consenting to the revised Terms.

15. Termination and Cancellation Policy

Either party may terminate this agreement without stating a reason by serving notice up to two (2) months before the end of the minimum period of use or the end of a renewal period. Termination must be in written form, preferably via email. For extraordinary termination, reasons must be provided in writing upon request. The agreement is initially effective for the minimum period selected by the Employer and will automatically renew for the same length of time unless terminated by either party.

16. Governing Law and Dispute Resolution

These Terms of Use and any disputes related to these Terms or the Service shall be governed by and construed in accordance with the laws of Germany. Disputes arising under these Terms shall be resolved through arbitration in courts located in Germany.
